These Terms & Conditions apply to the use of the Lume Alchemy website and to purchases made through the website.

By using this website or purchasing a personalized audio track, you agree to these Terms & Conditions.

1. The Lume Alchemy service

Lume Alchemy allows users to create personalized affirmation audio tracks. Depending on the options available at the time of purchase, users may be able to:

• record affirmations directly through the website;
• upload an existing voice recording;
• choose music provided by Lume Alchemy;
• upload their own music or audio;
• add an optional frequency;
• adjust the volume of their affirmations;
• make affirmations subliminal, softly audible or clearly audible;
• adjust playback speed;
• add additional voice layers;
• preview part of the track before purchasing;
• generate and download a personalized audio file.

Available features may change over time.

2. Personal responsibility for your content

You are responsible for the affirmations, recordings, music and other material you submit to the service. You confirm that you have the necessary rights and permissions to use any content you upload.

You may not upload material that:

• infringes copyrights, trademarks or other third-party rights;
• contains content that is unlawful;
• violates another person's privacy;
• contains recordings of another person without the necessary permission;
• is intended to misuse, disrupt or damage the website or service.

If you upload music or another recording that you did not create yourself, you are responsible for ensuring that you have permission to use it for this purpose.

3. Your voice recordings

Your voice recording is used for the purpose of creating the personalized audio track you request. Uploading or recording your voice does not transfer ownership of your voice or original recording to The Dream Miners BV. You grant The Dream Miners BV only the rights reasonably necessary to process the material and create and deliver the requested audio track.

Your recordings are uploaded to our servers only when you continue to payment. They are automatically deleted as soon as your track has been created, or within 4 days if no payment is completed. Full details are in our Privacy Policy.

4. Music provided by Lume Alchemy

Music, soundscapes and other audio supplied directly through Lume Alchemy may only be used as part of the personalized audio file produced through the service, unless expressly stated otherwise.

Purchasing a personalized track does not transfer ownership of the underlying music, recordings, branding, software or other Lume Alchemy intellectual property. Your finished track is intended for your personal use.

You may not commercially resell, redistribute, sublicense or make Lume Alchemy music or generated tracks publicly available as standalone content without prior written permission.

5. Frequencies, affirmations and intended use

Lume Alchemy audio tracks are intended for personal development, relaxation and general wellbeing purposes.

Affirmations, frequencies, binaural audio and similar features are not medical treatments and are not intended to diagnose, treat, cure or prevent any medical or psychological condition.

Individual experiences differ and Lume Alchemy does not guarantee any particular emotional, physical, financial, spiritual or other outcome from listening to a track. Nothing on the website should be considered medical, psychological, financial or other professional advice.

Where binaural audio or other features require headphones to create their intended audio effect, this is indicated on the website.

6. Price and payment

The total price is shown before payment. Unless stated otherwise, prices shown to consumers include applicable VAT where required.

Payments are processed through the payment methods made available during checkout. Payment processing is handled by Stripe. Lume Alchemy does not receive or store your complete payment-card details.

Your order is only considered paid when successful payment has been confirmed by the payment provider.

7. Creation and delivery

After payment has been successfully confirmed, your personalized audio track is generated using the settings you selected. Generation times may vary depending on file size, server availability and technical processing. A track is not considered ready until the website confirms that generation has been completed.

The customer is responsible for checking the preview and selected settings before completing the purchase. A difference that results directly from settings intentionally chosen by the customer, such as volume, speed, frequency intensity or voice layering, does not by itself constitute a defect.

This does not affect the consumer's statutory rights where the delivered digital content does not conform to the agreement.

8. Right of withdrawal

Consumers in the European Economic Area normally have a statutory right to withdraw from certain distance contracts within 14 days.

Because Lume Alchemy provides personalized digital content and begins processing shortly after purchase, you are asked during checkout to expressly request immediate performance of the agreement.

Where the legal requirements are met, the right of withdrawal for digital content supplied without a tangible medium is lost once performance has begun after the consumer has:

• expressly consented to performance beginning during the withdrawal period; and
• acknowledged that this causes the loss of the right of withdrawal in accordance with applicable law.

Nothing in these Terms limits any mandatory consumer rights that cannot legally be excluded.

9. Refunds and technical problems

Because each track is generated specifically using the customer's chosen recordings and settings, refunds are not automatically offered simply because a customer changes their mind after the performance of the digital content has validly begun and the statutory withdrawal right has been lost. This does not limit statutory consumer rights.

If:

• you paid but did not receive your track;
• your download is technically defective;
• the generated file materially differs from the configuration you purchased; or
• another technical problem prevents you from using the purchased content,

Where required by law, Lume Alchemy will first attempt to bring the digital content into conformity within a reasonable period and without additional charge.

10. Preview

The preview is intended to help you evaluate your selected settings before purchase. The complete generated track may contain repetitions, looping, layering or transitions that are not all present within a short preview. However, the final product should materially correspond to the configuration selected by the customer.

11. Availability of downloads

Your finished track remains available for download for 10 days after it has been created. After that period it is automatically deleted from our download storage. Please download your track and store it securely once it becomes available.

12. Intellectual property

The Lume Alchemy name, visual identity, website design, software, music, soundscapes, written content and other original material supplied by Lume Alchemy remain the intellectual property of The Dream Miners BV or its licensors.

The customer retains rights in their own original recordings and material. Creation of a personalized track does not transfer intellectual-property ownership in the underlying Lume Alchemy materials.

13. Website availability

We aim to keep the service available and functioning correctly but cannot guarantee uninterrupted access. Maintenance, internet outages, third-party service failures or technical problems may temporarily affect the website.

If a technical failure affects an already paid order, we will take reasonable steps to restore the order, regenerate the track or otherwise provide an appropriate remedy.

14. Liability

Nothing in these Terms excludes or limits liability where such limitation would be prohibited by applicable law.

To the extent permitted by law, The Dream Miners BV is not liable for indirect or consequential loss resulting from misuse of the service or from circumstances outside its reasonable control.

Users remain responsible for how and when they listen to audio generated through the service. Do not use audio in circumstances where reduced attention to your surroundings could create a safety risk, such as while driving or operating machinery.

15. Privacy

Personal data is processed in accordance with the Lume Alchemy Privacy Policy. Voice recordings and uploaded audio may constitute personal data and are handled in accordance with applicable data-protection laws.

16. Changes to these Terms

These Terms may be updated when the service, technology or applicable legal requirements change. The version applicable to a purchase is the version made available at the time the order was placed.

17. Complaints

Questions or complaints should first be sent to hello@lumealchemy.com. We will attempt to resolve complaints directly.

Consumers may also have access to applicable alternative dispute-resolution mechanisms. For disputes concerning a Belgian company, the Belgian Consumer Mediation Service can provide free out-of-court mediation after the consumer has first attempted to resolve the issue directly with the company.

18. Applicable law

These Terms are governed by Belgian law. For consumers, this choice of law does not deprive them of mandatory consumer protections they may have under the laws applicable to them.

Any dispute will be submitted to the competent court determined in accordance with applicable law, unless the parties resolve the matter amicably.
